Welcome to The Wild Orbit!

The Wild Orbit is a 360° travel and travel-experience brand operating across tour operations, travel management, trip organisation, expedition organisation, destination experiences and related travel services.

We curate, coordinate and facilitate travel arrangements for individuals, families, groups, private travellers and other guests, with a focus on meaningful, well-organised and responsible travel experiences.

These Terms & Conditions set out the basis on which The Wild Orbit provides, coordinates, arranges or facilitates travel services and experiences.

By making an enquiry, approving a quotation, making a payment or participating in a travel arrangement organised by The Wild Orbit, the Traveller acknowledges that they have read, understood and agreed to these Terms & Conditions.

About The Wild Orbit

The Wild Orbit operates as a tour operator, travel management expert, trip organiser, expedition organiser, travel experience curator and travel services provider.

Our services may include destination tours, customised and private trips, group travel, wildlife and nature experiences, expeditions, photography and birding experiences, accommodation, transportation, boat services, meals, guides, crew, permits, transfers and other travel-related services.

Depending on the nature of a booking, these services may be provided directly by The Wild Orbit or arranged, coordinated or facilitated through independent service providers, partners and other stakeholders.

A Travel Arrangement may therefore consist of several individual services integrated into one overall travel experience.

Definitions

For the purpose of these Terms & Conditions:

“The Wild Orbit”, “we”, “us” or “our” refers to The Wild Orbit.

“Traveller”, “Guest”, “you” or “your” refers to any individual, family, group or organisation making a booking or participating in a Travel Arrangement.

“Travel Arrangement” means one or more travel-related services, experiences or facilities curated, coordinated, arranged or facilitated by The Wild Orbit, whether provided directly by The Wild Orbit or through independent service providers, partners or other stakeholders.

“Tour” means a travel programme or package comprising the services and experiences specified in the applicable quotation or booking confirmation.

“Booking” means a Travel Arrangement that has been accepted by the Traveller and confirmed by The Wild Orbit after receipt of the required payment.

“Service Provider” means any hotel, resort, boat operator, transportation provider, guide, crew member, restaurant, permit authority or other independent provider involved in delivering a Travel Arrangement.

Enquiry, Quotation & Booking

The general booking process is: Enquiry → Quote → Traveller Approval → Advance Payment → Booking Confirmation → Final Payment → Travel

A quotation may contain the proposed itinerary, services, inclusions, exclusions, pricing and other details relevant to the proposed Travel Arrangement.

A quotation is not a confirmed booking by itself.

The Wild Orbit does not normally provide a temporary booking hold. Services and availability are confirmed only after the Traveller approves the quotation and makes the required payment, and the payment is acknowledged by The Wild Orbit.

Until confirmation, availability, pricing and other proposed arrangements may be subject to change.

Once a booking is confirmed, The Wild Orbit may begin securing the required services with its Service Providers and partners.

Pricing, Inclusions & Exclusions

The total tour cost is determined based on the services and experiences included in the confirmed quotation.

Pricing may depend on the travel dates, season, demand, group size, accommodation category, transportation, boat arrangements, permits, activities and other requirements.

The confirmed quotation will determine the services included in the particular Travel Arrangement.

Any service, facility or expense that is not specifically included in the confirmed quotation should be considered excluded.

Government charges, permits, entry fees, taxes and other mandatory costs may be included in the quoted price or charged separately depending on the nature of the arrangement.

Where applicable, changes in government charges, regulatory fees, supplier pricing or other mandatory costs may result in a corresponding adjustment to the final cost.

GST & Other Applicable Charges

GST and other applicable taxes, government charges, permit fees, entry fees and mandatory charges shall be applicable over and above the Tour Cost, unless expressly stated otherwise in the quotation or Booking Confirmation.

Taxes, Government Charges & Price Changes

The Tour Cost quoted by The Wild Orbit is based on the pricing, taxes, government charges, permits, Service Provider rates and other applicable costs known at the time of quotation.

Where applicable taxes, government fees, permit charges, entry fees, supplier rates, transportation costs or other mandatory charges change before the commencement of travel, the resulting difference may be payable by the Traveller.

Where such changes occur after a Booking has been confirmed and are outside the reasonable control of The Wild Orbit, we will communicate the applicable change to the Traveller as soon as reasonably practicable.

Payment Terms

The Wild Orbit follows a staged payment structure based on how far in advance the booking is made from the scheduled travel date.

This payment structure enables The Wild Orbit to secure and prepare transportation, boats, accommodation, food, guides, crew, permits and other services with the respective Service Providers and partners.

Bookings Made 3 Months or More in Advance

Where a booking is made 3 months or more before the actual travel date, 60% of the total tour cost is required to be paid at the time of booking.

The remaining 40% must be paid at least 45 days before the scheduled travel date.

Bookings Made 2 Months in Advance

Where a booking is made approximately 2 months before the actual travel date, 75% of the total tour cost is required to be paid at the time of booking.

The remaining 25% must be cleared at least 30 days before the scheduled travel date.

Bookings Made Within 45 Days of Travel

Where a booking is made within 45 days of the actual travel date, including bookings made approximately 30 days, 15 days or closer to the travel date, 100% of the total tour cost must be paid at the time of booking.

This requirement may apply because The Wild Orbit may need to make immediate and full financial commitments to Service Providers to secure the required arrangements within a limited timeframe.

Payment Confirmation & Late Payment

All payments must be made through the payment method or account details officially communicated by The Wild Orbit.

A booking will be considered confirmed only after the required payment has been successfully received and acknowledged by The Wild Orbit.

Where a scheduled payment remains unpaid, The Wild Orbit may issue payment reminders.

If the required payment is not received after reasonable reminders, The Wild Orbit may release or cancel the booking, subject to applicable cancellation charges and the actual commitments already made for the Travel Arrangement.

Payment Gateway Charges & Promotional Absorption

Any payment gateway, payment processor, transaction, convenience, currency-conversion or other applicable payment-related charges shall be payable over and above the Tour Cost.

However, The Wild Orbit may, at its discretion, offer promotional offers under which such payment gateway or processing charges may be absorbed by The Wild Orbit. Any such waiver or absorption shall apply only where expressly communicated as part of the applicable promotional offer.

Payment Reversals & Chargebacks

Where a Traveller initiates a payment reversal, chargeback or payment dispute through a bank, card issuer, payment gateway, wallet or other payment provider in relation to a confirmed Booking, The Wild Orbit may provide the relevant booking, quotation, payment, communication and service records to the concerned payment provider or authorised institution for review.

A payment dispute or chargeback does not automatically cancel the Traveller’s contractual obligations or applicable cancellation charges.

Where a payment is reversed after services have been secured, provided or committed by The Wild Orbit, the Traveller may remain liable for the applicable Tour Cost, cancellation charges, Service Provider liabilities and other legitimate amounts due, subject to applicable law.

The Wild Orbit will cooperate with the relevant payment provider or financial institution in reviewing any genuine payment dispute and will provide appropriate supporting documentation where reasonably required.

Official Communication & Fraud Prevention

The Wild Orbit may communicate with Travellers through its official email address, designated telephone number, messaging platform or other communication channel associated with the Booking.

Travellers should rely only on payment instructions officially communicated by The Wild Orbit.

The Wild Orbit will not be responsible for payments made to unauthorised individuals, personal accounts, fraudulent accounts or third parties where the payment was not made through an officially communicated payment channel.

Travellers are encouraged to verify any unusual payment request, change of bank details or other financial instruction directly with The Wild Orbit before making payment.

Cancellation, Cancellation Charges & Refunds

The Wild Orbit provides consolidated travel arrangements that may include transportation, boat services, accommodation, food, guides, crew, permits and other services arranged through different Service Providers, partners and stakeholders.

Once a booking is confirmed, The Wild Orbit may make advance payments, reservations and other financial commitments with the respective Service Providers to secure and prepare the required services for the Traveller.

Many of these services are arranged specifically for a particular Traveller or group. Once reserved, it may be difficult for The Wild Orbit or its service partners to resell, reallocate or recover the cost of those services if the Traveller subsequently cancels the booking.

Therefore, cancellation charges may apply to cover non-recoverable costs, supplier cancellation charges, advance commitments and other expenses incurred in preparing and securing the Travel Arrangement.

General Cancellation Guidelines

The following cancellation guidelines provide a general indication of the applicable cancellation charges:

  • Cancellation within 7 days of booking: Where a booking is made substantially in advance, such as around three months before the scheduled travel date, and the cancellation request is received within 7 days of the booking, a cancellation charge of approximately 10% of the total tour cost may apply.
  • Cancellation 46–60 days before travel: Approximately 45% of the total tour cost may be charged as a cancellation fee.
  • Cancellation 31–45 days before travel: Approximately 60% of the total tour cost may be charged as a cancellation fee.
  • Cancellation 16–30 days before travel: Approximately 75% of the total tour cost may be charged as a cancellation fee.
  • Cancellation within 15 days before travel: The entire tour cost may be treated as a cancellation charge, particularly where the services have already been secured, paid for or prepared and The Wild Orbit or its service partners are unable to resell or recover those services.

These percentages are general guidelines and are not intended to constitute an unconditional fixed refund schedule. The actual cancellation charge and refundable amount may vary depending on the circumstances of each booking.

Case-by-Case Cancellation Assessment

Since every Travel Arrangement may involve different Service Providers, booking conditions, seasons and financial commitments, cancellation requests will be assessed on a case-by-case basis.

The final cancellation cost may depend on, among other things:

  • When the booking was made.
  • When the cancellation request is received.
  • The number of days remaining before the travel date.
  • The season and prevailing demand.
  • Availability of accommodation, boats, transportation and other services.
  • Whether the respective services have already been reserved, confirmed or paid for.
  • Cancellation or retention charges imposed by hotels, resorts, boat operators, transportation providers, guides, crew or other service partners.
  • Whether the Service Provider is able to refund or adjust any amount paid by The Wild Orbit.
  • Whether the reserved service can be resold or reallocated to another Traveller.
  • Whether the booking can be shifted to an alternative travel date.
  • The availability and pricing of services on the alternative date.
  • Any special, customised or exclusive arrangements made for the Traveller.
  • Any permits, tickets, reservations or other charges that are non-refundable.
  • The actual financial commitments and non-recoverable costs incurred by The Wild Orbit and its Service Providers.

Where different components of a booking are subject to different cancellation conditions, the applicable cancellation cost may be assessed separately for those services.

Rescheduling & Alternative Travel Dates

The Wild Orbit believes in providing the highest level of Traveller and Customer satisfaction. Where a cancellation arises due to unavoidable circumstances, we will make reasonable efforts to minimise the cancellation cost wherever possible.

Depending on the circumstances, The Wild Orbit may explore the possibility of shifting the booking to an alternative travel date and adjusting eligible amounts towards the revised trip.

Such an adjustment may depend on the availability of the required services, supplier approval, seasonal pricing, demand, revised service costs and any additional charges applicable to the new travel date.

Any rescheduling or adjustment will be subject to availability and confirmation by The Wild Orbit and cannot be considered an automatic entitlement.

Refunds

Where a refund is applicable, the refundable amount will be determined after considering the applicable cancellation charges, non-recoverable costs, supplier charges and other financial commitments associated with the booking.

If The Wild Orbit is able to recover or adjust any amount from its Service Providers, or successfully reallocate a reserved service to another Traveller, such recovery may be considered while determining the final refund or alternative travel arrangement.

The applicable refund amount, if any, will be communicated to the Traveller after the cancellation has been assessed.

The Wild Orbit will make reasonable efforts to provide the fairest possible resolution while protecting the genuine costs already incurred in arranging and securing the Traveller’s journey.

Cancellation Requests

All cancellation requests should be communicated to The Wild Orbit through the official communication channel used for the booking.

The effective date of cancellation will generally be considered the date on which the cancellation request is received by The Wild Orbit.

A request communicated verbally or directly to an individual Service Provider, guide, crew member, hotel, boat operator or other third party will not be treated as a confirmed cancellation unless it is acknowledged by The Wild Orbit.

Our Approach

Cancellation charges are not intended to be punitive. They are intended to reasonably account for the costs, commitments and liabilities incurred in arranging services specifically for the Traveller.

The Wild Orbit will always try to work with the Traveller and its service partners to minimise avoidable losses and identify a practical solution wherever circumstances permit.

Depending on the circumstances, this may include recovery of amounts from Service Providers, adjustment towards a future travel date, rescheduling of the journey or consideration of amounts recovered through the resale or reallocation of services.

The final outcome will depend on the actual circumstances and financial commitments associated with the booking.

Rescheduling

Travellers may request a change to their scheduled travel date.

Rescheduling is subject to availability and confirmation by The Wild Orbit and the relevant Service Providers.

Applicable cancellation charges, supplier charges or other non-recoverable costs may apply depending on the circumstances.

Where eligible, the remaining amount after applicable charges may be adjusted towards the revised travel date.

The revised travel date may have a different quotation based on availability, season, demand, accommodation, transportation, boat services and other applicable costs.

Any difference in the revised tour cost will be payable by the Traveller.

Transfer/Substitution of Booking

A confirmed Booking is intended for the Traveller or Travellers named in the Booking Confirmation.

A Traveller may not transfer, sell, assign or substitute their Booking to another person without prior approval from The Wild Orbit.

Any approved substitution may be subject to availability, accommodation and transportation requirements, permits, government or authority regulations, Service Provider conditions and other operational requirements.

The Wild Orbit may require updated identification or other information from the substitute Traveller before approving the change.

Any additional cost, administrative charge, permit cost, supplier charge or difference in the Tour Cost arising from an approved substitution may be payable by the Traveller.

Approval of a substitution is not automatic and will depend on whether the change can reasonably be accommodated within the existing Travel Arrangement.

Itinerary & Operational Changes

The Wild Orbit makes reasonable efforts to operate the itinerary agreed at the time of booking.

However, travel conditions can change, particularly in destinations such as the Sundarbans.

Itinerary changes may become necessary due to permits, government or forest regulations, weather, tides, river conditions, safety requirements, wildlife conditions, transportation, accommodation availability or other unavoidable circumstances.

The Wild Orbit may therefore modify routes, timings, locations, activities, transportation, boat arrangements, accommodation or other itinerary components where reasonably necessary.

Where practicable, we will make reasonable efforts to provide a suitable alternative.

Operational changes made for safety, regulatory, environmental or unavoidable reasons do not automatically constitute cancellation of the entire Travel Arrangement.

Traveller-Initiated Changes During Travel

Once a Travel Arrangement has commenced, any request by a Traveller to change the agreed itinerary, accommodation, transportation, boat arrangement, activities, travel date or other service will be subject to operational feasibility and availability.

The Wild Orbit will make reasonable efforts to accommodate such requests wherever practicable. However, changes may not always be possible due to permits, tides, weather, transportation schedules, accommodation availability, Service Provider restrictions, government or forest regulations or other operational circumstances.

Any additional cost resulting from a Traveller-requested change, including transportation, accommodation, meals, activities, permits, Service Provider charges or other expenses, will generally be payable by the Traveller.

Where a Traveller chooses not to use a service that has already been arranged or paid for, the unused amount will not automatically be refundable.

Any adjustment or refund will be considered on a case-by-case basis after taking into account the actual costs incurred and amounts recoverable from the relevant Service Providers.

Wildlife & Natural Environment

The Wild Orbit offers travel experiences within natural environments where wildlife and environmental conditions cannot be controlled or predicted.

Wildlife sightings are never guaranteed.

The Wild Orbit does not guarantee sightings of the Royal Bengal Tiger or any particular animal, bird or other wildlife species.

Wildlife movement, behaviour, visibility, tides, weather and other natural conditions may affect the experience.

Our responsibility is to organise and facilitate a meaningful travel experience and provide opportunities for responsible observation and exploration. It does not extend to guaranteeing a particular wildlife encounter.

Permits & Regulatory Requirements

Certain destinations, protected areas and travel activities may require permits, permissions, entry tickets or compliance with government and local authority requirements.

The Wild Orbit may arrange or facilitate such requirements where included in the confirmed Travel Arrangement.

Travellers must provide accurate information and documents required for such arrangements.

Travellers must comply with all applicable laws, permit conditions, forest regulations, wildlife regulations, navigation requirements and instructions issued by the relevant authorities.

Where a permit or regulatory requirement affects the itinerary, The Wild Orbit may modify or restrict the relevant Travel Arrangement.

Traveller Documents & Entry Requirements

Travellers are responsible for ensuring that they have all valid and necessary documents required for their journey, including government-issued identification, passports, visas, permits, tickets, permissions, certificates and any other documents applicable to the Travel Arrangement.

Where The Wild Orbit assists with obtaining permits, permissions, tickets or other travel-related documentation, such assistance is provided as part of our travel management and coordination services and does not transfer the Traveller’s responsibility to ensure that their personal documents and eligibility requirements are valid and complete.

Travellers must provide accurate and complete information and documents within the timelines requested by The Wild Orbit. Any delay, cancellation, additional cost, denial of entry, denial of permit, disruption or inability to participate in the Travel Arrangement arising from incorrect, incomplete, expired or invalid documents or information may be the responsibility of the Traveller.

Where a government authority, forest authority, immigration authority, transport authority, Service Provider or other competent authority requires a particular document, identification, permission or eligibility condition, the Traveller must comply with such requirement.

The Wild Orbit cannot guarantee the approval or issuance of any visa, permit, government permission, entry approval or other document that is subject to the decision of an independent authority.

Any additional cost arising from documentation-related issues, including rebooking, additional transportation, accommodation, permits, administrative charges or other services, may be payable by the Traveller, subject to the circumstances and applicable terms of the relevant Service Provider or authority.

Traveller Responsibilities

Travellers are expected to provide accurate information required for planning and delivering their Travel Arrangement.

Travellers must arrive at designated locations at the agreed time and follow reasonable instructions provided by The Wild Orbit, its representatives, guides, crew, drivers, Service Providers and relevant authorities.

Travellers are responsible for maintaining respectful and responsible conduct throughout the journey.

Travellers must respect fellow Guests, local communities, Service Providers, guides, crew, wildlife and the environment.

No-Show, Late Arrival & Early Departure

Travellers are responsible for arriving at the designated meeting point, departure point or other specified location at the time communicated by The Wild Orbit.

If a Traveller fails to arrive at the scheduled time, arrives late or misses scheduled transportation, boat, activity, transfer or other service, The Wild Orbit and its Service Providers may not be able to delay or hold the service where doing so may affect the itinerary, safety, operations or other Travellers.

In such circumstances, the affected service may be treated as unused and may not be refundable.

Where reasonably practicable, The Wild Orbit may assist the Traveller in arranging an alternative service. Any additional transportation, accommodation, activity, permit, operational or other cost arising from such circumstances may be payable by the Traveller.

If a Traveller voluntarily leaves or ends the Travel Arrangement before its scheduled completion, the unused portion of the Travel Arrangement will not automatically be refundable.

Any refund or adjustment, where applicable, will be assessed based on the circumstances, services already utilised, supplier conditions and the possibility of recovering or reallocating the unused services.

Responsible Travel & Wildlife Conduct

The Wild Orbit is committed to responsible and respectful travel.

Travellers must not feed, chase, harass, provoke or intentionally disturb wildlife.

Travellers must not enter restricted areas, remove natural objects, damage vegetation or disturb nests, habitats or other sensitive ecological areas.

Littering, irresponsible disposal of plastic or waste and activities that may negatively affect the environment are prohibited or strongly discouraged depending on the applicable location and regulations.

Travellers must follow instructions provided by forest officials, guides, naturalists, crew and The Wild Orbit representatives regarding wildlife, environmental and visitor safety.

Safety, Health & Travel Insurance

Travel may involve boats, rivers, jetties, uneven surfaces, mudflats, forest environments, heat, humidity, rain, insects and remote locations.

Travellers should consider their own health, fitness and ability to participate safely in the selected Travel Arrangement.

The Wild Orbit recommends that Travellers obtain suitable travel insurance covering relevant medical, accident, cancellation, interruption, baggage and other travel-related risks.

Travellers should inform The Wild Orbit in advance about accessibility requirements or other arrangements that may reasonably affect the delivery of the Travel Arrangement.

The Wild Orbit does not impose a general age restriction on its travel arrangements. However, individual activities, Service Providers, authorities or safety requirements may have their own restrictions.

Parents or legal guardians remain responsible for minors travelling with them.

Boat & Water-Based Travel

Boat travel forms an important part of many Travel Arrangements offered by The Wild Orbit.

Travellers must follow all safety instructions provided by the boat operator, crew, guide, The Wild Orbit or relevant authorities.

Travellers must use available safety equipment as instructed and must not engage in behaviour that creates a risk to themselves, other Guests, crew, the vessel or the environment.

Boat routes, timings and movements may change because of tides, weather, river conditions, permits, safety requirements or authority instructions.

Accommodation, Transportation & Service Providers

The Wild Orbit may arrange accommodation, transportation, boat services, food, guides, crew and other travel services through independent Service Providers and partners.

These services may be subject to the individual policies, operating conditions, availability and requirements of the respective Service Provider.

The Wild Orbit will make reasonable efforts to coordinate and facilitate the services included in the confirmed Travel Arrangement.

Where a Service Provider becomes unavailable or circumstances require a change, The Wild Orbit may arrange a reasonable alternative where practicable.

Independent Service Providers

The Wild Orbit may arrange, coordinate or facilitate certain components of a Travel Arrangement through independent Service Providers, including hotels, resorts, boat operators, transportation providers, restaurants, guides, naturalists, crew members, activity operators and other travel partners.

The Wild Orbit will make reasonable efforts to coordinate suitable Service Providers and facilitate the services included in the confirmed Travel Arrangement.

However, individual Service Providers may operate under their own policies, procedures, schedules, safety requirements, facilities, terms and conditions, which may be outside the direct control of The Wild Orbit.

Where a Service Provider becomes unavailable, changes its operating conditions or is unable to provide a particular service, The Wild Orbit may, where reasonably practicable, arrange an alternative service or modify the relevant Travel Arrangement.

Where such circumstances arise, the applicable resolution will depend on availability, supplier policies, recoverability of amounts paid and the circumstances affecting the Travel Arrangement.

Personal Belongings & Property

Travellers are responsible for taking reasonable care of their own belongings, including luggage, cameras, mobile phones, electronic equipment, documents, cash and other personal items.

Travellers should not leave valuable belongings unattended.

The Wild Orbit cannot be responsible for loss or damage to personal belongings except to the extent required under applicable law.

Where damage to accommodation, boats, vehicles or any other asset belonging to The Wild Orbit, its Service Providers or partners is attributable to the Traveller, the Traveller may be required to bear the reasonable cost of repair or replacement, subject to appropriate assessment and supporting evidence.

Prohibited & Restricted Activities

  • Weapons are strictly prohibited during The Wild Orbit’s travel arrangements and excursions.
  • Illegal drugs are strictly prohibited.
  • Consumption of alcohol is not permitted while on board boats or during excursions.

Smoking may be permitted in designated or legally permitted areas. The Wild Orbit discourages smoking, particularly in environmentally sensitive areas.

Travellers must comply with all no-smoking restrictions applicable to a particular location, accommodation, vehicle, boat or excursion area.

Where smoking is prohibited, The Wild Orbit or its representatives may prevent the Traveller from smoking.

Any Traveller whose conduct creates a safety risk, violates applicable law or regulations, harms wildlife or the environment, or materially affects other Travellers, staff or Service Providers may be subject to appropriate action, including removal from an activity or Travel Arrangement where reasonably necessary.

Drones & Photography

Drone use during a The Wild Orbit Travel Arrangement is subject to applicable Government of India regulations and permissions from the respective authorities.

Travellers are responsible for obtaining any permissions, approvals or licences required for operating a drone.

The Wild Orbit does not guarantee that permission to operate a drone will be granted.

Photography and videography should always be conducted responsibly and must not disturb wildlife, local communities, other Travellers or restricted areas.

Guest Photographs, Testimonials & Content

The Wild Orbit may receive photographs, videos, reviews, testimonials or other content from Travellers relating to their travel experience.

Where appropriate consent has been provided, The Wild Orbit may use such content for promotional, marketing, website, social media or other brand communication purposes.

Travellers should not provide content that infringes the rights, privacy or intellectual property of another person.

Where specific consent is required for identifiable Traveller content, The Wild Orbit may seek such consent separately.

Force Majeure & Unavoidable Circumstances

Certain circumstances may arise that are beyond the reasonable control of The Wild Orbit or its Service Providers.

These may include extreme weather, cyclones, floods, natural disasters, government or authority restrictions, forest or protected-area closures, regulatory changes, transport disruptions, strikes, civil unrest, health emergencies and other unavoidable circumstances.

In such circumstances, The Wild Orbit may change the travel date, itinerary, route, services or other arrangements where reasonably necessary.

Where practicable, The Wild Orbit will explore alternative arrangements or rescheduling options.

The financial implications of such changes will depend on the circumstances, Service Provider policies, availability and amounts that can reasonably be recovered or adjusted.

Limitation of Liability

The Wild Orbit will make reasonable efforts to provide and coordinate the services included in the confirmed Travel Arrangement with due care and within the scope of the agreed services.

However, certain aspects of travel are dependent on circumstances and Service Providers outside the direct control of The Wild Orbit, including transportation, accommodation, boat operations, weather, tides, wildlife behaviour, government authorities, permits, forest regulations and other third-party services.

To the extent permitted by applicable law, The Wild Orbit shall not be responsible for loss, delay, disruption, additional expense or inconvenience arising from circumstances that are beyond its reasonable control or from the acts, omissions, policies or operational decisions of independent Service Providers.

The Wild Orbit shall also not be responsible for the loss, theft or damage of a Traveller’s personal belongings, except to the extent required under applicable law.

Nothing in these Terms & Conditions is intended to exclude or limit any liability that cannot lawfully be excluded or limited under applicable law.

Where The Wild Orbit is responsible for a particular service directly provided by it, its responsibility will be assessed based on the nature of that service, the circumstances involved and applicable law.
